Commissioner's Regulations Part 64 - Nursing

ยง64.6 Prescription and direction of nursing services

1.    Health care providers authorized to prescribe medical regimens to be executed by a registered professional nurse shall include persons licensed or authorized to practice pursuant to a limited permit or statutory exemption from the licensure requirement in the following licensed professions: medicine, including physician's assistant and specialist's assistant; dentistry; podiatry; midwifery; and nurse practitioner.

2.    Health care providers authorized to direct the performance of professional services by licensed practical nurses shall include persons licensed or authorized to practice pursuant to a limited permit or statutory exemption from the licensure requirement in the following licensed professions: medicine, including physician's assistant and specialist's assistant; dentistry; podiatry; midwifery; and registered professional nursing, including but not limited to nurse practitioners.

Commissioner's Regulations Section 135 - Health, Physical Education and Recreation

135.1 - Definition of terms used in the document.

135.2 - General regulations  - States all schools under the jurisdiction of NYSED shall provide programs of health, physical education and recreation; defines record keeping and transcripts, and the reporting to commissioner.

135.3  - Health Education - Defines elements of health education at elementary and secondary levels.

135.4  - Physical education - Describes required school district plans for both public and non-public schools.  Provides overview of requirements for interscholastic athletic activity.

135.5  - First aid knowledge and skills requirements for coaches including approved training courses.

135.6  - Comprehensive school health education demonstration program.  Defines health education in grades K-6 including coordination, implementation, and evaluatino of health instruction, instructor training, and development grant application process for health education programs.

School Health Services:
The New York City Department of Health and Mental Hygiene is responsible for providing health services pursuant to the New York City Charter and the New York City Health Code. The Department of Education of the City of New York is responsible for overseeing the provision of school health programs and services that are required by the New York State Education Law ("Ed Law") and New York State Public Health Law ("PHL"), and New York City Health Code. This regulation describes procedures for compliance with these laws and regulations.
